Minutes, public meeting of 12Jan2009
On 12Jan2009, the Derry Conservation Commission met in the 3rd floor meeting room of the Derry Municipal Center. The following members were present: P. Dionne, M. Ives, J. Arruda, R. Buzzanga, B. Ferrante, D. Wiley, E. Sarcione, and alternates A. Chapple, M. Page, and P. Kinsella, and Council representative N. Wetherbee.
Approval of Minutes:
M. Ives made a motion, seconded by R. Buzzanga, to accept the minutes of 10Nov2008. All present voted in agreement.
R. Buzzanga made a motion, seconded by M. Ives< to accept the minutes of 24Nov2008. All present voted in agreement with the exception of B. Ferrante who abstained.
Chairman’s report:
Chairman Dionne informed the Commission and the public that Bill Hoyt had resigned his position as an alternate. M.Ives publicly thanked Bill for his 14 years of service to the DCC.
Mary Holland sent the DCC a $250.00 contribution to be used for protection of open space. M. Ives made a motion, seconded by E. Sarcione, to accept the $250 donation. All voted in agreement.
A bill from Benson’s, believed to be in error, was presented to the Treasurer for resolution.
A bill from the Local Government Center for $25 was presented to the Treasurer for payment.
Two letters from Boutin Altieri concerning:
tax transfer of former Matteuzzi property to a conservation easement and,
tax transfer of Ferdinando parcel to a conservation easement.
DES correspondence, file #081215-01, application to alter terrain permit. DES questionnaire of same requesting additional information.
DES correspondence, file #081215-01, tax/lot 4/74 and 75, application to disturb approximately 150,000 sq ft for development purposes.
DES correspondence, file #081231-03, map/lot 104/3-155-2 and 160-59, application to disturb approximately 314,000 sq ft for development purposes.
DES correspondence, file # 081230-05, application from the Town of Derry to disturb approximately 123,000 sq ft for the widening of route 28.
DES correspondence, Shore land Impact permit to Andrew Plantz, 22 Coles Grove Rd., Derry, NH.
Southeast Land Trust of NH, baseline easement documentation for the Ferdinando parcel off of English Range Rd and an invoice for $7967.75 for all fees which included a $5000 “donation” for easement monitoring. R. Buzzanga made a motion, seconded by E. Sarcione, to authorize the Treasurer to pay the invoice. All present voted in agreement.
Weber Forrest Timber Trespass:
There was considerable discussion concerning the illegal clearing of trees at Weber Forest, by a Mr. Kevin Shaheen, to provide access to land which he purchased adjacent to the state recreational trail. A “meeting” had been conducted at the site between Mr. Shaheen and Town representatives A. Cote, C. Durette and P. Dionne. Mr. Shaheen was told to stop all clearing activates and informed as to the permits and procedures required. Following this meeting, a site walk was conducted by P. Dionne and D. Wiley. Additional site damage (hand dug drainage ditches) was observed which is allowing “untreated” water to enter the adjacent wet lands. Consequently the DCC decided to request legal action. R. Buzzanga made a motion, seconded by E. Sarcione, to authorize Chairman
Dionne to contact G. Stenthouse to initiate legal action against Mr. Kevin Shaheen for timber trespassing at Weber Forest. All present voted in agreement.
Community Technical Assistance Program (CTAP) Open Space Planning discussion:
CTAP has invited Derry to participate in a regional development of open space plan in anticipation of the widening of interstate highway 93. CTAP will provide technical support in the development of individual town planning documents. A minimum of 4 workshops are planned starting in late January. A motion was made by R. Buzzanga, seconded by M. Ives, to earmark an amount not to exceed $10000.00 to support the development of this plan. All present voted in agreement.
Fiscal Year 2009 Budget Request:
D. Wiley made a motion, seconded by M.Ives, to request a level budget of $5000.00 for administrative purposes for the year 2009. All present voted in agreement.
Other Business:
Jon Gaines of 56 Damren Rd, troop 405, Presentation of completed Eagle Scout Community Service project. Jon Gaines presented the DCC with a report and pictures of his completed service project at the Cole Marsh Conservation area. Jon answered questions concerning the 20 ft bridge that was constructed across the stream below the dam site. D. Wiley made a motion, seconded by M. Ives, requesting the Secretary issue a letter of completion to his Scout Master. All present voted in agreement.
Attorney Hugh Lee was present to discuss the recent decision by the NH Wet Lands Council and his subsequent appeal for reconsideration on the proposed Michael Subdivision off of Lawrence Rd. Mr. Lee suggested that a subdivision of this nature could be avoided in the future if the zoning ordinances were amended to include a buffer zone, with restrictions, to further protect wet lands. The suggested buffer zone would be in addition to the required setbacks which already exist. Chairman Dionne indicated that the DCC has made this suggestion to the Zoning Board and will continue to pursue the issue.
Ryan and Holly Juley of 11 Cole Rd approached the DCC to question their options in dealing with continued erosion from a culvert which is on their property. The original culvert, which allowed an existing stream to pass under Cole Rd, was increased in size by the Town when street drainage was added to collect storm runoff and divert it into the stream. A site walk was scheduled for Saturday the 17th at 8AM.
R. Buzzanga suggested the DCC form a subcommittee to deal with recreational issues such as the recent requests by the Derry Pathfinders. He accepted the task of initiating a subcommittee.
Peg Kinsella suggested that the DCC adopt a “Conservation Area of the Year” program to feature one of the conservation areas via news articles, schedule community hikes, etc. Her suggestion was well received.
